Applicant Remarks: New Sweden Irrigation District will use this water right for groundwater recharge in the Districts system of canals. The water would be diverted from the Snake River through either the Great Western canal or the Porter canal, and then distributed through the connecting laterals where possible to allow water to recharge through natural seepage. The District has a site at an existing regulating reservoir in section 11, T1S, R36E, which would also be used for additional recharge. Future recharge sites to be developed under future lease or ownership agreements. Water recharged to the aquifer under this water right will be used in mitigation plans that will be filed with IDWR over time.
On January 27, 2014, the Office of the Attorney General requested that IWRB be served all documents related to this ground water recharge application. Section 42-1737, Idaho Code, requires IWRB approval of managed ground water recharge projects in excess of ten thousand (10,000) acre-feet on an average annual basis. The applications propose ground water recharge projects which have the potential to divert in excess of ten thousand (10,000) acre-feet. The directive in section 42-1737, Idaho Code, provides sufficient reason to include the IWRB on the mailing list for proceedings in connection with the applications. Because IDWR does not currently have an a better method to add IWRB to the application and ensure they received service, I have added them as a security interest. IWRB is not a security interest to this application (csaxton 2-27-14).
