Water shall not be diverted from fire protection storage except to fight or repel an existing fire.

Recreation flow through water use under this right shall be non-consumptive.

Right 98-8035 authorizes a total annual storage volume of 0.6 acre-feet, 0.4 acre-feet to be used for the initial filling or carryover storage of the pond and 0.2 acre-feet for the replacement of losses caused by evaporation.

The pond established by the storage of water under this right shall not exceed a total capacity of 0.6 acre-feet or a total surface area of 0.1 acres.

Water stored under this right is subject to fluctuations of the water table caused by changes in the flow of local streams and by diversions under prior ground water rights. This right does not guarantee the maintenance of any particular ground water level.

Water shall not be diverted from Meadow Creek for Diversion to Storage Use under this right when flows in the Moyie River are below minimum flow amounts as defined by Right 98-7704. The right holder shall be responsible for monitoring the daily flow of the Moyie River using real-time data and shall cease diverting water when flows in the Moyie River are below established minimum flow amounts. Unless otherwise specified by the Director of the Department of Water Resources, data from the U.S. Geological Survey Eastport gauging station, No. 12306500, may be used for purposes of determining the daily flow amounts.

This right does not grant any right-of-way or easement across the land of another.
