Code Condtions
259 Right 98-7797 authorizes the storage of an annual total of 8.8 acre-feet, comprised of 5.0 acre-feet to be used for the initial filling of the pond, 2.8 acre-feet for the replacement of losses due to seepage and evaporation, and up to 1.0 acre-feet for additional refills for irrigation from storage use.
220 The five (5) ponds established by the storage of water under this right shall not exceed a total capacity of 5.0 acre-feet or a total surface area of 1.2 acres.
R58 This right when combined with all other rights shall provide no more than 3.0 afa per acre at the field headgate for irrigation of the place of use.
227 Water shall not be diverted under this right when flows in the Moyie River are below minimum flow amounts as defined by Right 98-7704. The right holder shall be responsible for monitoring the daily flow of the Moyie River using real-time data and shall cease diverting water when flows in the Moyie River are below established minimum flow amounts. Unless otherwise specified by the Director of the Department of Water Resources, data from the U.S. Geological Survey Eastport gauging station, No. 12306500, may be used for purposes of determining the daily flow amounts.
