Some of the water use authorized by this right is claimed with an earlier priority date on Clark Fork-Pend Oreille River Basins Adjudication Claim No. 96-9376. If Claim 96-9376 is decreed as it is claimed, Rights 96-9376 and 96-9723 when combined shall not exceed the irrigation of 3.6 acres.
218 Water shall not be diverted from fire protection storage except to fight or repel an existing fire.
259 Right 96-9723 authorizes the storage of an annual total of 5.0 acre-feet, comprised of 1.6 acre-feet to be used for the initial filling of the ponds, 0.4 acre-feet for the replacement of losses due to evaporation, and up to 3.0 acre-feet for additional refills for irrigation from storage use.
