The following rights are diverted through point(s) of diversion described above: 96-7454 and 96-9498.
Right 96-9498 industrial and irrigation water use(s) when combined shall not exceed an annual total diversion volume of 145 acre-feet.

Right 96-9498 authorizes the storage of an annual total of 169 acre-feet, comprised of 15.8 acre-feet to be used for the initial filling or carryover storage of the four (4) ponds, 8.2 acre-feet for the replacement of losses due to seepage and evaporation, and up to 145 acre-feet for additional refills for industrial water uses.

This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 3.0 afa per acre at the field headgate for irrigation of the place of use.

Rights 96-7616 and 96-9498 when combined shall not exceed the irrigation of 5.2 acres.

After specific notification by the Department, the right holder shall install a suitable measuring device or shall enter into an agreement with the Department to use power records to determine the amount of water diverted and shall annually report the information to the Department.

Some of the water use authorized by this right is claimed with an earlier priority date on Clark Fork-Pend Oreille River Basins Adjudication Claim No. 96-7454. If Claim 96-7454 is decreed as it is claimed, this right shall be diminished by the amount necessary to avoid any redundancy of water rights.
