Code Condtions
174 This right authorizes the diversion of ground water within the Rathdrum Prairie Ground Water Management Area (RPGWMA). Use of water under this right shall be subject to the provisions of the RPGWMA management plan approved by the director, including its conservation goals.
01R When notified by the Department, the right holder shall install and maintain a measuring device of a type acceptable to the Department as part of the diverting works.
175 When notified by the Department, the right holder shall record the quantity of water diverted and annually report diversions of water and/or other pertinent hydrologic and system information as required by Section 42-701, Idaho Code, and/or the management plan for the Rathdrum Prairie Ground Water Management Area.
Commercial use is for back-up water supply for Kootenai Medical Center.
The right holder shall make full beneficial use of all municipal water rights available to this facility. The right holder shall limit the diversion of ground water for commercial use under this right to those times when the municipal water supply is not available.
The volume of water diverted under this right as a back-up supply for commercial purposes shall not exceed 41.2 af per year.
If use of the municipal water rights available to this place of use are discontinued voluntarily by the right holder, this right shall not be used as a primary source of water for the hospital.
R66 This right when combined with all other rights shall provide no more than 0.03 cfs per acre nor more than 3.0 afa per acre at the field headgate for irrigation of the place of use.
004 This right does not grant any right-of-way or easement across the land of another.
