Prior to the diversion and use of water under this approval, the right holder shall comply with all fish screening and/or fish passage requirements of the Idaho Department of Fish and Game.
The following rights are diverted through the Unnamed Stream source point of diversion described above: 95-17841 & 95-18365.
123
Water stored under this right is subject to fluctuations of the water table caused by changes in the flow of local streams and by diversions under prior ground water rights. This right does not guarantee the maintenance of any particular ground water level.
218
Water shall not be diverted from fire protection storage except to fight or repel an existing fire.
259
Right 95-18365 authorizes the storage of an annual total of 31.1 acre-feet, comprised of 3.0 acre-feet to be used for the initial filling or carryover storage of the pond, 1.1 acre-feet for the replacement of losses due to seepage and evaporation, and up to 27.0 acre-feet for additional refills for irrigation from storage use.
220
The pond established by the storage of water under this right shall not exceed a total capacity of 3.0 acre-feet or a total surface area of 0.5 acres.
R58
This right when combined with all other rights shall provide no more than 3.0 afa per acre at the field headgate for irrigation of the place of use.
Rights 95-17841 & 95-18365 when combined shall not exceed a total annual maximum diversion volume of 27.0 af at the field headgate for the irrigation of 9.0 acres.
020
The diversion and use of water described in this right 95-18365 may be subject to additional conditions and limitations agreed to by the protestant and the right holder under a separate agreement to which the Department is not a party. Because the Department is not a party, the Department is not responsible for enforcement of any aspect of the agreement not specifically addressed in other conditions herein. Enforcement of those portions of the agreement not specifically addressed in other conditions shall be the responsibility of the protestant and the water right holder.
Pond dam shall be engineered to avoid failure and silt release.
The pond shall not have a flow through component, and will be topped off with tributary water only when necessary.
The applicant shall install diverting works components capable of turning off system if downstream senior water rights are not being met.
004
This right does not grant any right-of-way or easement across the land of another.
