218 Water shall not be diverted from fire protection storage except to fight or repel an existing fire.
220 The thirteen (13) ponds established by the storage of water under this right shall not exceed a total capacity of 59.8 acre-feet or a total surface area of 9.7 acres.
259 Right 95-15434 authorizes the storage of an annual total of 82.7 acre-feet, comprised of 59.8 acre-feet to be used for the initial filling or carryover storage of the 13 ponds, 13.3 acre-feet for the replacement of losses due to seepage and evaporation, and up to 9.6 acre-feet for additional refills for industrial from storage use.
Industrial use is for a landfill solid waste facility and dust abatement.
Pond(s) used under this right for the industrial storage of leachate runoff water shall maintain a pond liner to prevent contamination associated with ground seepage loss.
