The right holder shall accomplish the change authorized by Transfer No. 81464 by April 4, 2017.

Failure of the right holder to comply with the conditions of Transfer No. 81464 is cause for the Director to rescind approval of the transfer.

The approval Transfer No. 81464 redefines all of the elements of this water right, and the new use of water authorized by Transfer No. 81464 shall constitute the full extent of the right.

This right authorizes the diversion of ground water within the Rathdrum Prairie Ground Water Management Area (RPGWMA). Use of water under this right shall be subject to the provisions of the RPGWMA management plan approved by the director, including its conservation goals.

When notified by the Department, the right holder shall install and maintain a measuring device of a type acceptable to the Department as part of the diverting works.

When notified by the Department, the right holder shall record the quantity of water diverted and annually report diversions of water and/or other pertinent hydrologic and system information as required by Section 42-701, Idaho Code, and/or the management plan for the Rathdrum Prairie Ground Water Management Area.

Water shall not be diverted from fire protection storage except to fight or repel an existing fire.

This right authorizes a total annual storage volume of 0.9 acre-feet, 0.7 acre-feet to be used for the initial filling of the pond and 0.2 acre-feet for the replacement of losses caused by evaporation.

The pond established by the storage of water under this right shall not exceed a total capacity of 0.7 acre-feet or a total surface area of 0.14 acres.

The right holder shall install and maintain an impermeable liner in the pond to eliminate seepage losses.
