Water shall not be diverted under this right when flows in Wolf Lodge Creek are below minimum flow amounts as defined by Right 95-7874.

This right when combined with all other rights shall provide no more than 0.01 cfs nor more than 4.9 afa at the field headgate for irrigation of the place of use.

This right authorizes the diversion of an annual total of 5.1 acre-feet to be used for the initial filling of the pond, the replacement of losses caused by evaporation and for the storage of water for irrigation, stockwater, recreation and fire protection.

The pond established by the storage of water under this right shall not exceed a total capacity of 0.1 acre-feet or a total surface area of 0.01 acres.

Some of the water use authorized by this right is claimed with an earlier priority date on Coeur d'Alene and Spokane River Basin Adjudication Claim No. 95-12555. If Claim 95-12555 is decreed as it is claimed, this right shall be diminished by the amount necessary to avoid any redundancy of water rights.
