Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 95 A.

Water shall not be diverted for fire protection use under this right except to fight or repel an existing fire.

Right 95-10992 authorizes the diversion of an annual total of 21.6 acre-feet to be used for the initial filling of the pond, the replacement of losses caused by seepage and evaporation, and for the storage of water for irrigation and fire protection purposes.

The pond established by the storage of water under this right shall not exceed a total capacity of 4.8 acre-feet or a total surface area of 0.6 acres.

This right when combined with all other rights shall provide no more than 0.03 cfs per acre nor more than 3.0 afa per acre at the field headgate for irrigation of the place of use.

Rights 95-9488 and 95-10992 when combined shall not exceed a total diversion rate of 0.18 cfs, a total annual maximum diversion volume of 14.4 af at the field headgate, and the irrigation of 4.8 acres.

Some of the water use authorized by this right is claimed with an earlier priority date on Coeur d'Alene and Spokane River Basin Adjudication Claim No. 95-651. If Claim 95-651 is decreed as it is claimed, this right shall be diminished by the amount necessary to avoid any redundancy of water rights.
