The diversion and use of water described in this right is subject to additional limitations agreed to by the protestant and the right holder under separate agreement to which the Department is not a party and which may be enforceable by a court of law.

A fish screen of 0.25 inch or smaller mesh shall be installed and maintained at the point of diversion.

This right does not grant any right-of-way or easement across the land of another.

The two 2 ponds established by the storage of water under this right shall not exceed a total capacity of 4.0 acre-feet.

This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 3.0 afa per acre at the field headgate for irrigation of the lands above.
Through a separate agreement between the right holder and the Idaho Department of Fish & Game, which the Department of Water Resources is not a party and which may be independently enforceable by a court of law, the right holder agrees to cease the diversion of water for this right from Evans Creek, when the flow in Evans Creek below the point or points of diversion falls below 3.0 cfs.

The approach velocity at the point of diversion shall not exceed 0.5 feet per second.

This right authorizes the diversion of an annual total of 65.4 acre-feet to be used for the initial filling of the ponds, the replacement of losses caused by evaporation from the ponds, and for the storage of water for irrigation, wildlife and stockwater purposes.
