This right when combined with all other rights shall provide no more than 3.0 afa per acre at the field headgate for irrigation of the place of use.

Right 94-7426 authorizes the storage of an annual total of 197.7 acre-feet, comprised of 7.2 acre-feet to be used for the initial filling or carryover storage of the pond, 2.1 acre-feet for the replacement of losses due to seepage and evaporation, and up to 188.4 acre-feet for additional refills for irrigation from storage use.

The pond established by the storage of water under this right shall not exceed a total capacity of 7.2 acre-feet or a total surface area of 0.9 acres.

After specific notification by the Department, the right holder shall install a suitable measuring device or shall enter into an agreement with the Department to determine the amount of water diverted from power records and shall annually report the information to the Department.

Water shall not be diverted under this right when flows in the Coeur d'Alene River are below minimum flow amounts as defined by Right 94-7341. The right holder shall be responsible for monitoring the daily flow of the Coeur d'Alene River using real-time data and shall cease diverting water when flows in the Coeur d'Alene River are below established minimum flow amounts. Unless otherwise specified by the Director of the Department of Water Resources, data from the U.S. Geological Survey Cataldo gauging station, No.12413500 may be used for purposes of determining the daily flow amounts.
