Code Condtions
The Department of Water Resources retains jurisdiction to require deepening of the wells into the deeper aquifer upon determination by the Director that the use of the wells are preventing prior rights from obtaining water from the shallower aquifer. A flow measuring device of a type approved by the Department shall be maintained to allow the rate and volume of all water diverted under this right to be determined and recorded. The right holder shall provide a report annually, or more frequently if so requested, to the Department of the volume of water diverted under this right. Holding ponds operated as part of the irrigation system shall not exceed one-fourth (1/4) acre in total surface area and must be lined to prevent seepage in accordance with a plan approved by the Department prior to installation of the lining. Two points of diversion are located within the SWSE, S2, T35N, R5W.
R62 This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 3.0 afa per acre at the field headgate for irrigation of the lands above.
