Water shall not be diverted from fire protection storage except to fight or repel an existing fire.

Right 85-15764 authorizes the storage of an annual total of 8.9 acre-feet, comprised of 3.9 acre-feet to be used for the initial filling or carryover storage of the pond, 3.7 acre-feet for the replacement of losses due to seepage and evaporation, up to 0.6 acre-feet for additional refills for irrigation from storage use, and up to 07 acre-feet for additional refills for stockwater from storage use.

The pond established by the storage of water under this right shall not exceed a total capacity of 3.7 acre-feet or a total surface area of 0.7 acres.

This right when combined with all other rights shall provide no more than 0.6 acre-feet for irigation storage and irrigation from storage for the place of use.
Recreation use is for fishing.

Water shall not be diverted under this right when flows in Lawyer Creek are below minimum flow amounts as defined by Right 85-15616. The right holder shall be responsible for monitoring the daily flow of Lawyer Creek using real-time data and shall cease diverting water when flows in Lawyer Creek are below established minimum flow amounts. Unless otherwise specified by the Director of the Department of Water Resources, data from the U.S. Geological Survey Lawyer Creek at Kamiah gauging station, No. 13338950, may be used for purposes of determining the daily flow amounts.

Water shall not be diverted under this right when flows in the Clearwater River, Right 85-7583, are below established minimum flow amounts nor when flows in an Unnamed Stream, Right 85-15621, are below established minimum flow amounts.
