Water shall not be diverted from fire protection storage except to fight or repel an existing fire.

Right 81-12001 authorizes the storage of an annual total of 6.9 acre-feet, comprised of 4.0 acre-feet to be used for the initial filling or carryover storage of the four ponds, 1.9 acre-feet for the replacement of losses due to seepage and evaporation, up to 0.9 acre-feet for additional refills for irrigation from storage use, and up to 0.1 acre-feet for additional refills for stockwater from storage use.

The four (4) ponds established by the storage of water under this right shall not exceed a total capacity of 4.0 acre-feet or a total surface area of 0.8 acres.

Rights 81-2006, 81-7089, & 81-12001 when combined shall not exceed a total diversion rate of 1.00 cfs, nor a total annual diversion volume of 20.6 af for recreation storage use.

Water shall not be diverted under this right when flows in the Middle Fork of the Clearwater River are below minimum flow amounts as defined by Right 81-7162.
Recreation use is for swimming.

Upon specific notification by the Department, the right holder shall install and maintain acceptable measuring device(s), including data logger(s), at the authorized point(s) of diversion, in accordance with Department specifications.

After specific notification by the Department, the right holder shall install a suitable measuring device or shall enter into an agreement with the Department to use power records to determine the amount of water diverted and shall annually report the information to the Department.

This right does not grant any right-of-way or easement across the land of another.
