Rights 75-4324 and 75-15153 when combined shall not exceed a total diversion rate of 0.02 cfs for stockwater use.

Use of water under this right may be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 75F.

The quantity of water under this right and 75-15153 for stockwater use shall not exceed 13,000 gallons per day.

The quantity of water decreed for this water right for stockwater use is not a determination of historical beneficial use.

The approval of this transfer redefines all of the elements of this water right, and the new use of water authorized by this approval shall constitute the full extent of the right.
Diversion of water under this right is limited to the quantity of water available under the priority of this right at the original point of diversion on North Fork Salmon River at T24N R21E Sec 9 SWSW, or the quantity of water at the confluence of North Fork Salmon River and the Salmon River, whichever is less.

This right does not grant any right-of-way or easement across the land of another.

Prior to the diversion and use of water under this approval, the right holder shall comply with all fish screening and/or fish passage requirements of the Idaho Department of Fish and Game.

Point of diversion is located within Lot 1 of the River Rising Subdivision.

The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion.

This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 3.5 afa per acre at the field headgate for irrigation of the place of use.

The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.

Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.

Pursuant to Idaho Code § 42-1412(6), this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as determined by the Snake River Basin Adjudication court in the final unified decree entered 08/26/2014.
