This partial decree is subject to such general provisions necessary for the definition of the rights or for the efficient administration of the water rights as may be ultimately determined by the Court at a point in time no later than the entry of a final unified decree. Section 42-1412(6), Idaho Code.
The pond established by the storage of water under this right shall not exceed a total capacity of 0.3 acre-foot or a total surface area of 0.2 acre.
This right authorizes the diversion of an annual total of 0.7 acre-foot to be used for the initial filling of the pond, for the replacement of losses caused by seepage and evaporation from the pond.

Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. As of September 6, 2007, this water right is within State Water District No. 73.

The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion(s).

The right holder shall accomplish the change authorized by Transfer 73707 by September 6, 2008.

Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.

This right is limited to the irrigation of 175.1 acres within the place of use described above in a single irrigation season.

Prior to the diversion and use of water under this approval, the right holder shall comply with all fish screening and/or fish passage requirements of the Idaho Department of Fish and Game.

This right does not grant any right-of-way or easement across the land of another.

Water is delivered through P-8.
Rights 73-86C, 73-86D, 73-87, 73-96A, 73-96B, 73-97A and 73-10058 when combined shall not exceed the irrigation of 430.5 acres.

This right when combined with all other rights shall provide no more than 3.5 afa per acre at the field headgate for irrigation of the lands above.
