X35 Rights 73-157, 73-158, 73-2102 and 73-2155 when combined shall not exceed the irrigation of 255.3 acres.
X35 Rights 73-157, 73-158, 73-2102, 73-2155 and 73-12234 when combined shall not exceed the irrigation of 323.5 acres.
X35 Rights 73-157, 73-158 and 73-12234 when combined shall not exceed a total diversion rate of 11.88 cfs.
Water under this right shall only be delivered when there is insufficient water in the Pahsimeroi River and Patterson Creek (Spring Creek) to deliver 11.88 cfs using water rights 73-12234 and 73-157, and then only to the extent of supplying 11.88 cfs.
X35 Rights 73-157, 73-158, 73-2102, 73-2155, 73-7022, 73-12179, 73-12218, 73-12233 and 73-12234 when combined shall not exceed a total diversion rate of 28.92 cfs and the irrigation of 951.2 acres.
D09 The appropriator is entitled to the quantity of water described above at the point of measurement in T14N, R22E, S26, SWSW.
R05 Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 73.
R43 The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion(s).
R63 This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 3.5 afa per acre at the field headgate for irrigation of the place of use.
004 This right does not grant any right-of-way or easement across the land of another.
029 Prior to the diversion and use of water under this approval, the right holder shall comply with all fish screening and/or fish passage requirements of the Idaho Department of Fish and Game.
T07 The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
T19 Pursuant to Section 42-1412(6), Idaho Code, this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as may be determined by the Snake River Basin Adjudication court at a point in time no later than the entry of the final unified decree.
