In the event that the holder of a licensed or decreed water right that is senior in priority to this right, including a stockwatering right, diverting water within a radial distance of 3,300 feet of the Upper Facility wells alleges that water is not available to satisfy the senior right because of interference caused by the exercise of this junior priority right at the Upper Facility wells, the holder of this junior priority right shall immediately be required to establish to the satisfaction of the Director of the Department of Water Resources that either: a. The unsatisfied senior water right is not being materially affected by the diversion of water under this junior priority water right; or b. Other physical factor(s) are present, such as the use of an unreasonable means of diversion, which prevent the senior right from being fully satisfied. If either 1a or 1b can not be established to the satisfaction of the Director of the Department of Water Resources, use of water under this right shall be curtailed absent mitigation approved by the Director of the Department of Water Resources.
The right holder shall maintain adequate measuring devices that will measure the rate and volume of water diverted from the wells used as points of diversion for this right.
027 Use of water under this right shall be non-consumptive.
