X35 Rights 72-147, 72-148, 72-4028, 72-4029, and 72-4177 when combined shall not exceed the irrigation of 154.2 acres.
R59 This right when combined with all other rights shall provide no more than 3.5 afa per acre at the field headgate for irrigation of the lands above.
The diversion of water under this right through the point of diversion in the NENESE, S23, T15N, R19E is limited to a maximum diversion rate of 3.00 cfs and the diversion of water under this right through the point of diversion in Government Lot 7 (NESWSW) S24, T15N, R19E is limited to a maximum diversion rate of 9.21 cfs.
029 Prior to the diversion and use of water under this approval, the right holder shall comply with all fish screening requirements of the Idaho Department of Fish and Game.
R05 Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 72F.
T18 Prior to diversion of water under this approval, the right holder shall provide a means of measurement and lockable controlling works for all authorized points of diversion. The means of measurement and controlling works must be suitable for control of the diversions and acceptable to the watermaster.
004 This right does not grant any right-of-way or easement across the land of another.
X36 Rights 72-147, 72-148, 72-149, 72-150, and 72-16273 are also diverted through the point of diversion described above within the NENESE, S23, T15N, R19E.
T07 The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
T19 Pursuant to Section 42-1412(6), Idaho Code, this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as may be determined by the Snake River Basin Adjudication court at a point in time no later than the entry of the final unified decree.
