The total instantaneous diversion of water from all points of diversion under Right 72-4053 shall not exceed 2.00 cfs.

Prior to diversion of water under this approval, the right holder shall provide a means of measurement acceptable to the Department from all active authorized points of diversion which will allow determination of the total rate of diversion.
This right is limited to the quantity of water beneficially used for mining purposes as described under this right.

After specific notification by the Department, the right holder shall measure the diversion or shall enter into an agreement with the Department to determine the amount of water diverted from power records and shall annually report the information to the Department.

The mining operation authorized under this approval shall comply with applicable county, state and federal requirements.

Use of water under this approval shall comply with applicable water quality standards of the Department of Environmental Quality.

The right holder shall comply with all fish screening requirements of the Idaho Department of Fish and Game.

Use of water under this right may be affected by a Snake River Basin Adjudication stipulation agreement between United States, acting on behalf of United States Department of Agriculture, Forest Service, and the right holder.

Approval of Transfer 69178 does not grant any right-of-way or easement for use of this right on property owned by person(s) other than the right owner.

The right holder shall accomplish the change authorized by this transfer within one (1) year of the date of this approval.

Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.

Pursuant to Section 42-1412(6), Idaho Code, this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as may be determined by the Snake River Basin Adjudication court at a point in time no later than the entry of the final unified decree.
The place of use located in portions of unsurveyed Section 29, Township 13N, Range 15E, is also identified as patented private land recorded as The Square Deal Placer and New Deal Placer, part of Mineral Survey 3644.
