Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 170.

The right holder shall maintain measuring device(s), including data logger(s), and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion(s).

The right holder shall make full beneficial use of water rights 72-32E, 72-2147B, 72-2149H, and 72-4158 for irrigation of the lands authorized to be irrigated under this right. The right holder shall limit the diversion of ground water under this right to those times when the surface water supply is not available or the surface water supply is not reasonably sufficient to irrigate the place of use authorized under this right.

Domestic use is for 1 home. Irrigation of lawn, garden and landscaping associated with the home is authorized under the irrigation component of this right.

If the surface water right(s) appurtenant to the place of use is abandoned, forfeited, sold, transferred, leased or used on any other place of use, this right to divert ground water shall not be used for irrigation purposes without an approved transfer pursuant to Section 42-222, Idaho Code, or approval of the Department if a transfer is not required.

When notified by the Department or by a watermaster with regulatory authority over this right, the right holder shall report the amount of water diverted in connection with this right. The report shall be submitted in the manner and frequency specified by the Department or the watermaster.
Wildlife and aesthetic storage is for a pond with a capacity of 2.5 af. This right authorizes the annual diversion of 2.5 af to fill the pond and 0.7 af to replace evaporation losses from the pond.

The pond established by the storage of water under this right shall not exceed a total capacity of 2.5 acre-feet or a total surface area of 0.31 acres.
