R05 Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 71.
The right holder shall maintain a permanent measuring device in such a manner that the amount of water entering the reservoirs can be measured.
020 The diversion and use of water described in this right may be subject to additional conditions and limitations agreed to by the protestant(s) and the right holder under separate agreement to which the Department is not a party and which may be enforceable by a court of law.
This right is for two on-stream reservoirs totaling 3.2 af. The total combined diversion volume under rights 71-7178, 71-7179, and 71-10929 shall not exceed 3.2 af plus the amount necessary to replace evaporation and seepage losses from the reservoirs, up to a combined maximum of 4.2 af.
029 The right holder shall comply with all fish screening and bypass requirements of the Idaho Department of Fish and Game.
T07 The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
