Right No. 71-69, 71-11005, 71-11006, 71-11020 & 71-11021 are also diverted through points of diversion described above.
After specific notification by the department, the right holder shall annually report the amount of water diverted to the department.
Prior to diversion of water under this approval, the right holder shall provide a means of measurement acceptable to the department from all authorized points of diversion which will allow determination of the total rate of diversion.
The total instantaneous diversion of water from all points of diversion under Transfer No. 5105 shall not exceed 8.52 cfs, nor total combined annual volume of 436.2 af at the field headgate.
This right when combined with all other rights shall provide no more than 3.0 afa per acre at the field headgate for the irrigation of the lands above.
046 Right holder shall comply with the drilling permit requirements of Section 42-235, Idaho Code. All wells must be completed in alluvium and not develop deep bedrock or hot water aquifers.
Diversion of groundwater is limited to those times water is available for diversion under this right and priority from the Alturas Lake Creek.
029 The right holder shall comply with all fish screening requirements of the Idaho Department of Fish and Game.
Diversion from Alturas Lake Creek shall cease and all pumps shall be removed from the creek upon completion of the wells and ground water system.
Right Nos. 71-64A and 71-69 when combined shall not exceed a total annual diversion volume of 413.4 af for the irrigation of 137.8 total acres.
Three points of diversion are located within NWNE, S05, T07N, R14E; one well located in the HES 289, and one well and pump from Alturas Lake Creek within Government Lot 1.
Two points of diversion are located within SWNE, S05, T07N, R14E; one well in Government Lot 4 and one pump from Alturas Lake Creek within HES 289.
Stockwater is for 10 horses.
C18 THIS PARTIAL DECREE IS SUBJECT TO SUCH GENERAL PROVISIONS NECESSARY FOR THE DEFINITION OF THE RIGHTS OR FOR THE EFFICIENT ADMINISTRATION OF THE WATER RIGHTS AS MAY BE ULTIMATELY DETERMINED BY THE COURT AT A POINT IN TIME NO LATER THAN THE ENTRY OF A FINAL UNIFIED DECREE. SECTION 42-1412(6), IDAHO CODE.
