This right is limited to the irrigation of a specific 48.7 acres within the 343 acre place of use authorized by this right in a single irrigation season. The specific 48.7 acres to be irrigated by the right holder are shown in the electronic shape file associated with this right in the geographic information system component of the water rights database maintained by the department. Before changing the 48.7 acres to be irrigated within the 343 acre place of use, the right holder shall submit a new land list and representative electronic shape file or map to the Department prior to the irrigation season in which the change will occur.

Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 71.

The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversions.

This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 3.0 afa per acre at the field headgate for irrigation of the place of use.

Transfer 80786 authorizes the diversion and delivery of 0.16 cfs and 2.7 af of water to storage for replacement of evaporative losses from the pond authorized by Right 71-10972.

This right mitigates for the depletion of water resulting from the diversion and use of water under 71-10957 and evaporative losses associated with the recreation use under 71-10954. To prevent injury to other water right holders, the right holder shall cease diverting 0.02 cfs of this right from Warm Creek for the irrigation of 0.4 acres.
If the mitigation portion of this right is not deliverable due to a shortage of water or a priority call, then the amount of water authorized for diversion under the uses of Right 71-10957 and the recreation use under Right 71-10954 that are being mitigated shall be reduced by the same proportion as the reduction to this right.

Rights 71-2078 and 71-10972 authorize 3.5 acre-feet to be used for the initial filling or carryover storage of the pond, 2.7 acre-feet for the replacement of losses caused by evaporation and a total annual storage volume of 6.2 acre-feet.

The pond established by the storage of water under rights 71-2078 and 71-10972 shall not exceed a total capacity of 3.5 acre-feet or a total surface area of 0.44 acres.
Irrigation diversion occurring from the pond that is described by rights 71-2078 and 71-10972 shall not exceed the amount of water diverted into the pond from Warm Creek under this right for irrigation purposes (2.71 cfs) and shall only occur when water is being diverted into the pond from Warm Creek under this right for irrigation purposes. When irrigation diversion is not actively occurring from the pond, diversions to the pond under this right shall be limited to 0.16 cfs and when combined with right 71-10972 the total diversion for non-irrigation purposes is limited to a combined total of 0.61 cfs.

The right holder shall accomplish the change authorized by this transfer within five years of the date of this approval.
T08
Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.

Pursuant to Section 42-1412(6), Idaho Code, this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as determined by the Snake River Basin Adjudication court in the final unified decree entered 08/26/2014.
