For the next four irrigation seasons following licensing of this right, the right holder shall record rate and volume measurements monthly for any calendar year in which water is diverted in connection with this right and shall make the records available to the department upon request. One measurement shall be in April for each year this right is being used.
Any well used as a point of diversion for this right shall include a measuring tube or other suitable method to allow measurement of water levels. For the next four irrigation seasons following licensing of this right, the right holder shall measure static water levels for any well used as a point of diversion for this right monthly for any calendar year in which water is diverted in connection with this right and shall make the records available to the department upon request. One measurement shall be in April for each year this right is being used.
Any well used as a point of diversion for this right shall be cased with impermeable casing into or through the first confining layer below ground surface to prevent diversion of water having a direct hydraulic connection to surface water sources within the Weiser River Basin.
Upon notification by the department, the right holder shall conduct a pump test and/or shall participate in a monitoring plan subject to department approval prior to being implemented. This may be done by the right holder or in conjunction with another party.
After notification by the department, the right holder shall annually submit a measurement report to the department. The report shall include the rate, volume and water level data for any irrigation well authorized by this right and all data from any observation well that could be required in a pump test and/or monitoring plan.

After notification by the department, the right holder shall install a standard measuring device acceptable to the department to replace the non-standard measuring method in place and approved by the department at the time of licensing this right. This shall also include annually submitting a measurement report to the department. The report shall include the rate, volume and water level data for any irrigation well authorized by this right and all data from any observation well that could be required in a pump test and/or monitoring plan.

This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 4.0 afa per acre at the field headgate for irrigation of the place of use.
Violation of any condition of this right is cause for the Director to cancel or revoke the approval.

This right does not grant any right-of-way or easement across the land of another.

When ordered by the Director, the right holder shall provide mitigation acceptable to the Director to offset depletion of lower Snake River flows needed for migrating anadromous fish. The amount of water required for mitigation, which is to be released into the Snake River or a tributary for this purpose, will be determined by the Director based upon the reduction in flow caused by the use of water pursuant to this right. Any order of the Director issued in accordance with this paragraph shall be in conformance with applicable rules allowing the right holder due process as the need for mitigation and the amount of mitigation are determined.
