R05
Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 65.
R43
The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion.
020
The diversion and use of water described in Transfer 70461 may be subject to additional conditions and limitations agreed to by the protestant and the right holder under separate agreement to which the Department is not a party and which may be enforceable by a court of law.
The total diversion to storage and wildlife storage components of this water right cannot exceed a total of 139.5 acre-feet annually. Total diversion volume for the entire water right is limited to 486 acre-feet annually. Upon petition from another affected water user, or on its own initiative, IDWR may require measurement and reporting of the flow rate and annual volume of water diverted to insure compliance with these limitations.
X35
Rights 65-805 and 65-3348, when combined shall not exceed a total diversion rate of 4.87 cfs, a total annual maximum diversion volume of 468 af at the field headgate and the irrigation of 73 acres.
Rights 65-805, 65-3348, and 65-22473, when combined shall not exceed a total diversion rate of 4.87 cfs.
R61
This right when combined with all other rights shall provide no more than 4.5 afa per acre at the field headgate for irrigation of the lands above.
X56
The portion of Right 65-805 used for conveyance losses is 1.33 cfs.
The diversion rate of .034 cfs per acre at the field headgate is included in the rate of diversion for the place of use described above.
X61
The period of use for the irrigation and diversion to storage described in this approval may be extended to a beginning date of 3/1 provided that beneficial use of the water can be shown and other elements of the right are not exceeded. The use of water before 3/15 is subordinate to all water rights having no subordinated early or late irrigation use and a priority date earlier than the date of this approval.
T07
The right holder shall accomplish the change authorized by this transfer within one (1) year of the date of this approval.
T08
Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
T19
Pursuant to Section 42-1412(6), Idaho Code, this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as may be determined by the Snake River Basin Adjudication court at a point in time no later than the entry of the final unified decree.
