Code Condtions
R02 A lockable device subject to the approval of the Department shall be maintained on the diverting works in a manner that will provide the watermaster suitable control of the diversion.
Water shall not be diverted under this right when flows in the Payette River are below established minimum stream flows. Point of diversion is located within Lot 16, Blk. 1, Garden Valley Estates No. 1. Place of use is located within Lots 2 & 4, Blk. 2, Garden Valley Estates No. 1.
R63 This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 3.5 afa per acre at the field headgate for irrigation of the lands above.
R04 Use of water under this water right will be regulated by the watermaster of State Water District No. &DISTRICT.
029 The right holder shall comply with all fish screening requirements of the Idaho Department of Fish and Game.
120 The Director retains jurisdiction to require the right holder to provide purchased or leased natural flow or stored water to offset depletion of Lower Snake River flows needed for salmon migration purposes. The amount of water required to be released into the Snake River or a tributary for this purpose will be determined by the Director based upon the reduction in flow caused by the use of water pursuant to this permit.
