Heating use is for use in the City of Boise geothermal water system, from water diverted within the Boise Front Low Temperature Geothermal Resource Ground Water Management Area. A map depicting the heating place of use boundary for this water right at the time of this approval is attached to this document solely for illustrative purposes.
Water diverted pursuant to this right may also be used within the Boise Warm Springs Water District (place of use described under water right 63-5073) and the State of Idaho Geothermal System (place of use described under water right 63-9341) to provide an emergency source of water for heating purposes. Use of the water as an emergency source for Boise Warm Springs Water District and the State of Idaho Geothermal System is subject to the diversion rate and volume limits of this right.
004 This right does not grant any right-of-way or easement across the land of another.
The right holder shall maintain a measuring device or devices suitable for determining the instantaneous rate of diversion and cumulative annual diversion volume, as part of the diverting works. The type of measuring device shall be subject to the approval of the Department.
In addition to all other legal rights, remedies and authorities, the Department may curtail or limit the use of water under this right to remedy, without limitation: (1) depletion or other adverse effects on the Boise Front Low Temperature Geothermal Resource Management Area aquifer system, (2) increased pumping lift or decreased pressure in an existing prior user well, or (3) temperature decline causing an existing user system operating at reasonable efficiency to no longer operate.
R07 Return flow discharged to a subsurface system must be authorized by an injection well permit. An existing injection well is located at T03N R02E S10 SWNWSE (Injection Well Permit No. 63W-135-001). Any change in depth or location of the injection well must be authorized by the Department.
The right holder shall maintain a measuring device suitable for determining the cumulative annual volume of water injected into the subsurface system.
Production limits under this right shall not exceed City injection by more than an average of 92.1 acre-feet (af) (30 million gallons) per year for any five (5) year period, and production shall not exceed injection by more than 153 af (50 million gallons) in any single year. Provided, production may exceed injection by more than 153 af per year in any single year only to the extent required due to catastrophic system failure, acts of God, war, fire, flood, other natural disaster, or other emergency circumstances. In such circumstances, the City must re-attain a rate of injection of all production in excess of 92.1 af per year as soon as feasible.
When notified and instructed by the Department, the right holder shall record and report the quantity of water diverted, the quantity of water injected into the subsurface, and other pertinent hydrologic and system information.
930 Water bearing zone to be appropriated is 642 to 1897 feet.
The diversion and use of water described in this license is subject to the following particular provisions of those certain stipulated agreements among the parties In the Matter of Petition for Order Authorizing Additional Use Under Existing Permits and Moratorium Order for Water Rights 63-9138 & 63-9139 in the name of the City of Boise, as such provisions have been and may be modified by agreement of the parties and acceptance by the Department in accordance with these stipulated agreements: a. 2002 Stipulated Agreement For Settlement in Part and Stay of Proceedings Regarding Remainder of Petition (“2002 Agreement”), Section II.C, as modified by the 2010 Second Stipulated Agreement for Settlement in Part of Petition and Stay of Further Proceedings (“2010 Agreement”): Section II.3 (monitoring and reporting plan); b. 2010 Agreement: Section II.4 (annual Department and City reports) and Section II.5 (annual meeting to review the Section II.4 reports; but not the Section II.6 review referenced in Section II.5); and c. 2010 Agreement: Section II.12 (City contingency mitigation plan) and Section II.13 (IWRRI model review).
