R32 This right when combined with all other rights shall provide no more than .02 cfs per acre nor more than 4.5 afa per acre for irrigation of the lands above.
This right authorizes only supplemental use of water. Ground water diverted under this right cannot be used as the sole source of water supply but must always be associated with another primary water supply from either a surface water or ground water source. Surface water shall continue to be used as the primary source of supply for the ground upon which it is now appurtenant, and ground water shall be used only when surface water supplies are insufficient for irrigation of the property. The Department retains jurisdiction over this right to require monitoring and reporting of ground water levels if it finds that ground water levels are declining in observation wells near or within the development.
