205 The approval of transfer 87042 redefines all of the elements of this water right, and the new use of water authorized by this approval shall constitute the full extent of the right.
X06 Industrial use is for a data center.
WD8 The place of industrial use authorized by this right may include land upon which wastewater may be applied for irrigation purposes to satisfy water quality requirements. Water diverted under this right shall not be used for irrigation unless the water is first used in the industrial facility as authorized by this water right.
186 Diversion of water under water right nos. 63-3362, 63-11347, 63-34795, and 63-35388 from the points of diversion authorized under Transfer 87042 located in the SWSE of Section 31, T2N, R2E, and in NENE of Section 06, T1N, R2E shall not exceed a total combined maximum diversion rate of 2.23 cfs.
212 Prior to diversion and use of water under Transfer approval 87042, the right holder shall install and maintain acceptable measuring device(s) and lockable controlling works at the authorized point(s) of diversion, in accordance with Department specifications.
067 The right holder shall record the quantity of water diverted and annually report diversions of water as required by Idaho Code § 42-701.
046 Right holder shall comply with the drilling permit requirements of Section 42-235, Idaho Code and applicable Well Construction Rules of the Department.
073 Diversion and use of water with a temperature greater than 85 degrees Fahrenheit is not authorized under this right.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
T07 The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
020 The diversion and use of water described in this right may be subject to additional conditions and limitations agreed to by the protestant and the right holder under a separate agreement to which the Department is not a party. Because the Department is not a party, the Department is not responsible for enforcement of any aspect of the agreement not specifically addressed in other conditions herein. Enforcement of those portions of the agreement not specifically addressed in other conditions shall be the responsibility of the protestant and the water right holder.
