Code Condtions
219 Rights 63-31690 and 63-34002 authorize total annual storage volume of 118.8 acre-feet to be used for the initial filling of ponds.
220 The seven (7) ponds established by the storage of water under rights 63-31690 and 63-34002 shall not exceed a total capacity of 118.8 acre-feet or a total surface area of 16.5 acres.
936 Per Transfers 70620 and 79654 for mitigation for consumptive use of water, rights 63-192, 63-19425, and 63-216C authorize the diversion of 48.0 af of water to storage to offset evaporation losses from the seven (7) ponds authorized by rights 63-31690 and 63-34002.
If the specified mitigation rights are not deliverable due to a shortage of water or a priority call, then the amount of water authorized for diversion under this license shall be reduced by the same proportion as the reduction to the mitigation rights.
930 Water bearing zone to be appropriated is from 0 to 18 feet.
123 Water stored under this right is subject to fluctuations of the water table caused by changes in the flow of local streams and by diversions under prior ground water rights. This right does not guarantee the maintenance of any particular ground water level.
140 Noncompliance with any condition of this right, including the requirement for mitigation, is cause for the director to issue a notice of violation, cancel or revoke the right, or, if the right is included in a water district, request that the watermaster curtail diversion and use of water.
Aesthetic storage use is for excavated ponds on Banbury Golf Course.
