This right does not grant any right-of-way or easement across the land of another.

Diversion and use of water with a temperature greater than 85 degrees Fahrenheit is not authorized under this right.

Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No.63.

After specific notification by the Department, the right holder shall install a suitable measuring device or shall enter into an agreement with the Department to use power records to determine the amount of water diverted and shall annually report the information to the Department.

Upon specific notification by the Department, the right holder shall install a lockable device of a type acceptable to the Department in a manner that will provide the watermaster suitable control of the diversion.

Water bearing zone to be appropriated is 75 to 95 feet.

Commercial use is for a water education and research facility.
To prevent injury to prior water rights appropriating water from the Boise River and/or underlying shallow aquifer tributary to the Boise River, water diverted under this right shall be fully discharged to Cottonwood Creek within the NE 1/4 of NW 1/4 Section 11, T03N, R02E.
