Water stored under this right shall not be used for irrigation purposes.
Aesthetic storage under this right is solely for the purpose of authorizing the storage of water in the six ponds identified in the place of use. This right does not authorize additional diversion of water to cover evaporative losses and seepage for pond maintenance. Rights 63-31726 and 63-31689 provide water to replace seepage and evaporative losses from the ponds.
020 The diversion and use of water described in this right may be subject to additional conditions and limitations agreed to by the protestant(s) and the right holder under separate agreement to which the Department is not a party and which may be enforceable by a court of law.
The ponds constructed in connection with this right shall be lined with bentonite or other impervious material to minimize seepage losses.
Should refilling and/or maintaining the water level in the ponds require more water than is authorized for diversion under Rights 63-31726 and 63-31689, the right holder shall rent water from the water supply bank or provide water from another water right or source in a manner recognized and approved by the Department.
