Water bearing zone to be appropriated is from 50 to 318 feet.
The wells constructed and used as points of diversion for this right shall be no deeper than the blue clay layer located approximately 290 to 318 feet below ground surface.
Water diverted and used under this right shall be discharged into the Purdam Gulch Drain.
If the right holder cannot continue to discharge all the water diverted under this right into the Purdam Gulch Drain for any reason, the right holder shall cease diverting water under this right until the right holder implements an alternative mitigation plan that has been reviewed and approved by the Department.
R19 The right holder shall maintain totalizing measuring devices approved by the Department to measure and record the rate and volume of ground water diverted in connection with this right and the volume of water being released from the commercial facility into Purdam Gulch Drain. The right holder shall measure and record the entire volume of water diverted under this right and the entire volume of water discharged to the Purdam Gulch Drain and shall make the records available to the Department for inspection at any time.
027 Use of water under this right shall be non-consumptive.
Commercial use is for a cheese making process.
