The 10 ponds established by the storage of water under this right shall not exceed a total capacity of 272.0 acre-feet or a total surface area of 15.6 acres.

Water stored under this right is subject to fluctuations of the water table caused by changes in the flow of local streams and by diversions under prior ground water rights. This right does not guarantee the maintenance of any particular ground water level.

Per Transfer 73632, Right 63-146 authorizes the diversion of 0.36 cfs and 66.4 af of water to storage to offset evaporation and seepage losses from the pond(s) authorized by this right.

The right holder shall maintain control of 18.1 shares of New Union Ditch Company LTD representing the portion of Right 63-146 used for storage purposes in concert with this right.
Right holder shall install and maintain a measuring device acceptable to the Department to regulate water that is diverted into the Lakeland Village irrigation/pond system. Furthermore, the right holder shall ensure that U.S. Bureau of Reclamation (Reclamation) storage water will not be used for the aesthetic storage component of Lakeland's deliveries by reducing the total flow of water delivered by 0.02 cfs at any time that the New Union Ditch Company is receiving Reclamation storage water, and will provide proof accordingly when requested by Reclamation or the State Watermaster.
