Code Condtions
This right authorizes diversion of Boise River water flowing in the Loggers Creek Extension only after water is diverted into Loggers Creek from the Boise River under other valid water rights. Water cannot be diverted directly from the Boise River to deliver water to this water right, but delivery is solely dependent on other rights authorizing direct diversion from the Boise River.
R05 Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 63.
004 This right does not grant any right-of-way or easement across the land of another.
The right holder shall retain one share of stock of South Boise Water Company right 63-185B, authorizing the delivery of water for aesthetic use. The share of stock shall be retained for the purpose of mitigating the evaporative losses in the aesthetic channels authorized by this right. The water equivalent to one share of irrigation stock shall be delivered by the South Boise Water Company to the right holder, and the right holder shall pass the water on to the Boise River through its aesthetic channels.
R43 The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion(s).
