Conditions
Code
Condtions
Water diverted and stored under this right shall not be used for irrigation purposes.
Storage of water within the six ponds is authorized under right no. 63-32169.
The ponds constructed in connection with this right shall be lined with bentonite or other impervious material to minimize seepage losses.
X35
Rights 63-31726 and 63-31689 when combined shall not exceed a total diversion rate of 0.18 cfs and a total annual maximum diversion volume of 40.0 af.
Water bearing zone to be appropriated is from 90 to 100 feet.
The well constructed and used as the point of diversion for this right shall not exceed a maximum depth of 100 feet and a maximum diameter of six inches.
Aesthetic storage under this right is to replace seepage losses in six ponds located within Brookwood Subdivision.
R43
The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion(s).
020
The diversion and use of water described in this right may be subject to additional conditions and limitations agreed to by the protestant(s) and the right holder under separate agreement to which the Department is not a party and which may be enforceable by a court of law.
104
Because Right 63-31726 provides for all of the evaporation losses in connection with the six ponds, water shall not be diverted under this right if Right 63-31726 is transferred, leased, or used on any other place of use unless the Department approves an alternative plan to offset the evaporation losses resulting from the impoundment of water in connection with the ponds.
140
Noncompliance with any condition of this right, including the requirement for mitigation, is cause for the director to issue a notice of violation, cancel or revoke the right, or, if the right is included in a water district, request that the watermaster curtail diversion and use of water.
