124	Place of use is within the service area of the City of Caldwell municipal water supply system as provided for under Idaho Law.
180	A map depicting the place of use boundary for this water right at the time of this approval is attached to this document for illustrative purposes.
102	The right holder shall not provide water diverted under this right for the irrigation of land having appurtenant surface water rights as a primary source of irrigation water except when the surface water rights are not available for use. This condition applies to all land with appurtenant surface water rights, including land converted from irrigated agricultural use to other land uses but still requiring water to irrigate lawns and landscaping.
212	Prior to diversion and use of water under Transfer approval 85741, the right holder shall install and maintain acceptable measuring device(s) at the authorized point(s) of diversion, in accordance with Department specifications.
01Q	After specific notification by the Department, the right holder shall record the quantity of water diverted and shall annually report the information to the Department.
	The well serving as the point of diversion for this right shall be continuously cased and sealed from land surface to the top of the completion aquifer at 199 feet below ground level. The seal shall consist of an approved grout pumped into place from the base of the casing, or a solid bentonite chip poured into place, into a uniform annular space surrounding the centralized casing.
930	Water bearing zone is between 199 and 320 feet.
208	To the extent necessary for administration between points of diversion for ground water, and between points of diversion for ground water and hydraulically connected surface sources, ground water was first diverted under this right from Well 17A located in T03N R03W S10 SENE.

	Transfer 89462 authorizes the following additional well as a point of diversion under this right as of the date of the approval: Well 22 located in T04N R03W S33 SWSW.
	Transfer 90127 authorizes the following additional well(s) as point(s) of diversion under this right as of the date of the approval: Well no. 23 located in T03N R03W S9 NWNE Well no. 24 located in T03N R03W S11 SESW
	Diversion of water from the additional wells authorized under Transfer 90127 located in T03N R03W S9 NWNE and T03N R03W S11 SESW shall not exceed a total combined maximum diversion rate of 8.91 cfs under rights 63-3441, 63-5051, 63-5053, 63-5054, 63-5055, 63-7158, 63-7910, 63-8008, 63-8299, 63-8986, 63-8987, 63-9358, 63-10316, 63-10317, 63-12144, 63-31283, 63-31550, 63-32024, 63-32025, 63-32026, 63-32027, 63-32028, 63-32029, 63-32030, 63-32031, 63-32032, 63-32033, 63-32038.
004	This right does not grant any right-of-way or easement across the land of another.
046	Right holder shall comply with the drilling permit requirements of Idaho Code § 42-235 and applicable Well Construction Rules of the Department.
T07	The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08	Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
103	When ordered by the Director, the right holder shall provide mitigation acceptable to the Director to offset depletion of lower Snake River flows needed for migrating anadromous fish. The amount of water required for mitigation, which is to be released into the Snake River or a tributary for this purpose, will be determined by the Director based upon the reduction in flow caused by the use of water pursuant to this right. Any order of the Director issued in accordance with this paragraph shall be in conformance with applicable rules allowing the right holder due process as the need for mitigation and the amount of mitigation are determined.
