Water bearing zone to be appropriated is 100 - 300 feet.
027 Use of water under this right shall be non-consumptive. All ground water diverted shall be injected back into the same aquifer from which it was diverted and shall not be exposed to or mixed with other water, fluids, or chemicals before injection. Failure to directly replace the ground water diverted is cause for the director to revoke the license.
The use of water under this right shall not injure other water rights. The test for injury includes a change in aquifer temperature that might negatively affect the beneficial use authorized by prior water rights.
01M After specific notification by the Department, the right holder shall install a suitable measuring device or shall enter into an agreement with the Department to use power records to determine the amount of water diverted and shall annually report the information to the Department.
