Code Condtions
124 Place of use is within the service area of the City of Nampa municipal water supply system as provided for under Idaho Law.
180 A map generally depicting the service area for this water right at the time of this approval is attached to this document for illustrative purposes.
This water right is part of the non-potable water delivery system for the city of Nampa.
102 The right holder shall not provide water diverted under this right for the irrigation of land having appurtenant surface water rights as a primary source of irrigation water except when the surface water rights are not available for use or where the use of surface water was replaced by the use of water diverted in connection with this right before the approval of Transfer 82046. This condition applies to all land with appurtenant surface water rights, including land converted from irrigated agricultural use to other land uses but still requiring water to irrigate lawns and landscaping.
01M After specific notification by the Department, the right holder shall install a suitable measuring device or shall enter into an agreement with the Department to use power records to determine the amount of water diverted and shall annually report the information to the Department.
To the extent necessary for administration between points of diversion for ground water, and between points of diversion for ground water and hydraulically connected surface sources, ground water was first diverted under this right at the Phyllis, Kohler Lawn Cemetery #1, Kohler Lawn Cemetery #2, East Powerline, 19th Ave North, 15th Ave North, 14th Ave North, Indian, Meyer, Chestnut, Kurtz, Maple, Holly, Fern, 19th South, 14th South, High Street, Hudson, and 4th St South Wells located in T3N, R2W: Sec 22, SENE; Sec 15, NESW; Sec 15, SWSE; Sec 23, SWSE; Sec 23, SWSW; Sec 23, NWSW; Sec 22, NESE; Sec. 23 SWSW; Sec 26, NWSW; Sec 34, NENE; Sec 34, NWNE; Sec 27, SWNW; Sec 27, SENW; Sec 27, SWNE; Sec 27, SENE; Sec 27, NENW; Sec 21, NESE; Sec 21, NESE; and Sec 22, SESW.
Transfer 82046 authorizes the following additional well(s): Locust Lane Well located in T02N R02W S04 SWSE as a point(s) of diversion under this right as of the date of approval. 004 This right does not grant any right-of-way or easement across the land of another.
T07 The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
T19 Pursuant to Section 42-1412(6), Idaho Code, this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as determined by the Snake River Basin Adjudication court in the final unified decree entered 08/26/2014.
