X27 This right is limited to the irrigation of 25 acres within the authorized place of use in a single irrigation season.
X35 Rights 63-22210 and 63-32570 when combined shall not exceed the irrigation of 482 acres.
206 Rights 63-2343, 63-3178A, 63-22210, 63-32570, 63-32571, and 63-34911 are limited to the irrigation of a specific 916.0 acres within the 1010.0 acre place of use authorized by this right in a single irrigation season. The specific 916.0 acres to be irrigated by the right holder shall be identified prior to use by submittal of a land list and a representative electronic shape file or by submittal of a land list and a map sufficiently detailed to allow creation of an electronic shape file to be associated with this right in the geographic information system component of the water rights database maintained by the department. Before changing the 916.0 acres to be irrigated within the 1010.0 acre place of use, the right holder shall submit a new land list and representative electronic shape file or map to the Department prior to the irrigation season in which the change will occur.
R65 This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 4.5 afa per acre at the field headgate for irrigation of the lands above.
R43 The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion(s).
Transfer No. 84020 authorizes the diversion of this right from Dixie Drain as an exchange of Bardsley Gulch Drain water for Dixie Drain water.
X53 Diversion water from the Dixie Drain is limited to those times water is available for diversion under this right and priority from the Bardsley Gulch Drain.
X49 Prior to diversion of water under this approval, the right holder shall provide a means of measurement acceptable to the department for measuring the flow in Bardsley Gulch Drain at the original point of diversion and at the point of diversion from the Dixie Drain.
176 The waste water diverted under this right is subject to the right of the original appropriator, in good faith and in compliance with state laws governing changes in use and/or expansion of water rights, to cease wasting water, to change the place of use or manner of wasting it, or to recapture it.
T07 The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
T19 Pursuant to Idaho Code § 42-1412(6), this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as determined by the Snake River Basin Adjudication court in the final unified decree entered 08/26/2014.
