Upon specific notification by the Department, the right holder shall install a lockable device of a type acceptable to the Department in a manner that will provide the watermaster suitable control of the diversion.

The issuance of this right does not grant any right-of-way or easement across the land of another.

Use of water under this water right will be regulated by the watermaster of State Water District No. 63, Boise River.

When notified by the Department, the right holder shall install and maintain a measuring device of a type acceptable to the Department as part of the diverting works.
This right does not authorize the diversion of water released for stream flow maintenance during the non-irrigation season under prior right 63-03618. When flow in the Boise River at the point of diversion is being maintained solely by releasing water under right 63-03618, the right holder shall cease diverting water or shall provide for storage water or some other source of water to be released into the Boise River to replace the amount being diverted.

Use of water under this right shall be non-consumptive.
Aesthetic use is for a continuous flow of water through an existing pond. This right does not authorize storage of water in the pond.
