080 This right authorizes an annual volume of water to fill the storage facility and the amount required to replace losses through evaporation and seepage.
The Director maintains jurisdiction of this right until February 14, 2001 in order to determine if there is an adverse effect upon prior water rights in the area. Upon a determination by the department of injury caused by the non-irrigation season pumping authorized by this right, the Director may cancel the right with prejudice. The right holder is not authorized to release water pumped and impounded under terms of this right down the irrigation canal. Rights 63-11964, 63-12164, and 63-12273 when combined shall not exceed a total diversion rate of 0.13 cfs. Rights 63-11964, 63-12164 and 63-12273 are limited to a combined storage volume of 1.7 af; this right combined with Right 63-11964 authorize the annual volume measured in the filling of the storage facility and the replacement of losses through evaporation and seepage. Rights 63-11964 and 63-12164 are also diverted through the point(s) of diversion described above. Aesthetic storage is for 2 ponds.
