Conditions

Code Condtions
The right holder must retain ownership of seven shares of Boise Valley Canal Company water for mitigation purposes. Surface water delivered pursuant to the shares must be delivered to a recharge area where it must completely percolate into the ground water. Ground water can only be diverted for irrigation purposes during the period when surface water is being delivered by the Boise Valley Canal Company. If consumptive water rights are granted in the Treasure Valley by IDWR in the future, the right holder may petition IDWR to remove the mitigation requirement. The director retains jurisdiction over this right to monitor the implementation of the mitigation plan and to require adjustments at any time. This right when combined with all other rights shall provide no more than 0.04 cfs per acre nor more than 4.5 afa per acre at the field headgate for irrigation of the lands above.
01M After specific notification by the department, the right holder shall install a suitable measuring device or shall enter into an agreement with the department to determine the amount of water diverted from power records and shall annually report the information to the department.
