The measuring device shall be maintained by the right holder and shall be made available to inspection by Department personnel for the purpose of long-range study and monitoring of the ground water aquifer. The right holder shall maintain records of the amount of water diverted under this right. |
|
The right holder is responsible to ensure that pumpage under this right does not directly cause the water level to significantly decline in any domestic wells drilled and in use prior to March 29, 1978, or any irrigation well drilled and in use prior to July 1, 1953, or to cause the water level in any other well having a prior right to exceed a reasonable pumping level, unless the right holder provides reasonable compensation or mitigation to the prior water right holder for the reduced water levels as determined by the Director. |

After specific notification by the Department, the right holder shall record the quantity of water diverted or shall enter into an agreement with the Department to use power records to determine the amount of water diverted and shall annually report the information to the Department. |

The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval. |

Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer. |
