R39 A measuring device and lockable controlling works of a type acceptable to the Department shall be permanently installed and maintained as part of the diverting works.
R04 Use of water under this water right will be regulated by the watermaster of State Water District No. &DISTRICT.
Single point of diversion located on or near the line between NESE and NWSE, S23, T04N, R01E. Right 63-10348 is also diverted through the point of diversion described above. Use of water under this right shall be non-consumptive. At such times in the future as the Director determines necessary to protect the prior rights of other users, the Director may require determination of the rate of loss within the system using a procedure approved by the Director, and may require mitigation for all system losses. The total combined rate of diversion under this right and Right 63-10348 shall not exceed 5.29 cfs. This right does not authorize the diversion of water released from storage for stream flow maintenance under prior right 63-03618. The pond associated with this right shall not exceed a total volume of 0.41 acre-feet nor a total surface area of 0.11 acres.
