R05 Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 63.
X35 Rights 63-11273 and 63-11934 when combined shall not exceed the irrigation of 139.1 acres.
WB7 This right when combined with all other rights shall provide no more than 4.5 afa per acre at the field headgate for irrigation of the lands above.
The water authorized for impoundment in the pond authorized by this right consists of the groundwater diverted pursuant to right no. 63-11273 and the existing share of Boise River water owned by the applicant and currently delivered through the Hart-Davis Ditch. The right holder is not authorized to otherwise appropriate or divert water from the Boise River to the pond under this approval.
This right does not authorize the appropriation of any ground water or surface water in addition to the water which the right holder already has a right to divert and use.
The right holder shall not divert a volume of water from the pond in excess of the volume of water the right holder has injected into the pond authorized by this right.
The right holder is authorized to redivert water from the pond when: a) The right holder is simultaneously injecting water from surface water and/or from ground water diverted pursuant to other water rights into the pond, or when b) The right holder can show that the water in the pond was previously injected into the pond from surface water or from ground water diverted pursuant to other water rights during the irrigation season.
Upon a determination of need by the department, the right holder shall install measuring equipment specified by the department to assure that the applicant does not divert and/or impound more water than authorized under existing water rights during the irrigation season.
