This right when combined with all other rights shall provide no more than .02 cfs per acre nor more than 4.5 afa per acre for irrigation of the lands above.
The right holder is responsible to ensure that pumpage under these water rights does not cause the water level in any irrigation of commercial well to exceed the reasonable pumping level, unless the holder of the prior water right receives reasonable compensation or mitigation for the reduced water level caused directly or indirectly by the withdrawal of water under these water rights.
The right holder is responsible to ensure that pumpage under these water rights does not directly cause the water level in any domestic well drilled and in use prior to March 29, 1978, to be lowered so as to require modification to the well or pumping system or to cause the water level in any other well having a prior right to exceed a reasonable pumping level, unless the right holder provides a reasonable compensation or mitigation, as determined by the Director, to the prior water right holder for the reduced water levels.
Water diverted under these water rights is supplemental to surface water rights and may be used only in connection with the primary surface water rights from the Boise River. These rights may be utilized only during irrigation seasons when the surface water allotments for the 285 acres will not provide a sufficient supply of irrigation water.
The rate of diversion of Water Right No. 63-11474 when combined with Water Right No. 63-11551 shall not exceed 3.87 cfs.
Upon a determination of need by the Department, the right holder shall install a flow measurement port or other device as specified by the Department to provide for the measurement of the rate of diversion.
The right holder shall utilize available surface water rights to the fullest extent and shall utililize ground water only as a secondary source.
